COPYRIGHT AND RELATED RIGHTS

Copyright is defined as a group of principles and legal norms aimed to protect authors (as creators) and other entitled persons or entities (such as producers), granting powers to practice the free trading of their work. In addition, copyrights protect the work itself. WIPO has established that, in legal terminology, the term “copyright” describe the rights of creators over their literary and artistic Works. Items that might be bound by copyrights include books, music, paintings, sculptures, software and other IT programs, databases, ads, maps, and technical drawings. 

The purpose of our legal advice with respect to copyrights and related rights is the legal protection of authors and owners of national and foreign rights. We also offer legal advice to producers of software, databases, film and entertainment industries, photography, artistic collections, music, and literary works.  

We focus on designing the best legal strategy for each creator so through his or her work and creativity artists may earn improved and sustained income; so this is the manner in which we support Guatemala’s cultural development. 

Our Copyright services include: the preparing and presenting the pertinent registration application of the work to the National Registry of Intellectual Property, and drafting, negotiating, revising and submitting contracts regarding Copyright and related rights.

We can give advice on writing licenses and transfers of powers granted by copyright holders to third parties. 

We resolve disputes and conflicts over copyrights and related rights in cases in which our client face claims of third parties, or when the authors and / or right holders face problems of illegal reproduction or commercial use (without authorization) of their works.
